July 28, 2009 – Kimberly McGinley, 32 years old from Dedham, Massachusetts, has died as a result serious personal injuries sustained when she was hit by a car in Somerville. The car was driven by Zeggai S. Malu, 71 from Somerville. The accident occurred at approximately 3:30 PM on Sunday.
McGinley was walking on the sidewalk with a two year old Roslindale child when Malu’s Nissan Pathfinder jumped the curb and struck them. McGinley and the child were headed to a party for McGinley’s 6 year old daughter on Munroe Street in Somerville. According to witnesses, McGinley saw the car coming and courageously pushed several children out of harm’s way.
McGinley was taken to Massachusetts General Hospital and passed away late Monday night. The child has yet to be indentified and remains hospitalized but is in stable condition. It appears that McGinley and the child knew one another but were not related.
McGinley was one of the top make-up artists in Boston and was a former model in Europe and the United States. She leaves behind two children, ages 6 and 3, and her husband, Patrick.
On Monday, Malu’s license was revoked by the Massachusetts Registry of Motor Vehicles. Malu has no prior incidences on his driving record except for a speeding ticket from 1993. There are no pending criminal charges listed at this time.
The accident remains under investigation by the Somerville Police Crash Reconstruction Unit.
Unfortunately, this summer has had several other fatal accidents involving elderly drivers. Just this past weekend, 7 year old Herbert Whitaker of Halifax was killed when he was crossing the street with his father and was hit by a car driven by a 76 year old. On July 12th, Richard Kelly, 55 from Pelham, New Hampshire, died when his 2005 Harley-Davidson motorcycle was struck by an elderly driver. In June, 4 year old Diya Patel was killed as she was crossing the street in Stoughton and was hit by an 86 year old driver.
